whiskerchat - Terms of Service

1. Eligibility

You must be at least 13 years of age, or the age of digital consent in your jurisdiction, to create an account and use the App. If you are under the age of majority, you must have permission from a parent or legal guardian.

2. Account Registration

To use Whiskerchat, you are required to sign in using either your email address with a one-time passcode (OTP), Apple Sign-In, or Google OAuth. We do not collect or store any user passwords. You agree to provide accurate, complete, and current information during registration and to keep this information up to date.

3. Description of Service

Whiskerchat is an AI-powered chat application that allows users to interact with a simulated pet persona. Conversations are powered by third-party artificial intelligence services, including OpenAI and Gemini APIs.

4. Use of the App

By using the App, you agree not to:

• Violate any applicable law or regulation;
• Use the App to transmit any content that is unlawful, harmful, abusive, harassing, or otherwise objectionable;
• Infringe on any third-party rights;
• Interfere with the proper functioning of the App or attempt to gain unauthorized access to our systems;
• Use automated means to access or interact with the App.

5. AI-Generated Content and Disclaimer

Whiskerchat uses AI technologies provided by OpenAI and Gemini. You acknowledge and agree that all responses are autonomously generated based on user inputs and are not moderated prior to display. AI content may be fictional, incorrect, or inappropriate. We make no representations or warranties about the suitability, accuracy, or safety of any content generated by AI. By using the App, you agree that we are not liable for any harm, distress, or loss that may result from AI interactions.

6. User Responsibility and Indemnification

You are solely responsible for any content you provide, including inputs to the AI. You agree not to input or promote content that is illegal, offensive, or infringes on the rights of others. You agree to indemnify and hold us harmless from any claims or liabilities arising from your use of the App or content generated based on your inputs.

7. Subscription Terms

Whiskerchat offers a subscription plan through Apple In-App Purchases managed by RevenueCat. By subscribing, you agree to the following:

• Your Apple ID will be charged at the time of purchase confirmation.
• Subscriptions auto-renew unless canceled at least 24 hours before the end of the billing cycle.
• Renewal charges will be applied 24 hours prior to the next billing cycle.
• You may cancel your subscription in your iOS device's Account Settings.
• No refunds are issued for unused portions of the subscription period.
• We reserve the right to change pricing or features with prior notice.

8. Termination

We reserve the right to suspend or terminate your access to the App at our sole discretion, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users or our business interests.

9. Disclaimers

THE APP AND ALL CONTENT ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

11. Third-Party Services

Whiskerchat integrates with third-party services such as Supabase, RevenueCat, OpenAI, Gemini, and Sentry. We are not liable for errors, security breaches, or service interruptions originating from these external services. Their respective terms and privacy policies govern their use.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of The Netherlands, without regard to conflict of laws principles. You agree to submit to the exclusive jurisdiction of the courts located in The Netherlands.
